These Terms of Service ("Terms") govern your use of OpenLearn AI's website, web chat, Telegram bot, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
Service Provider
The Service is provided by Pavel Igorevich Shepshelevich (Шепшелевич Павел Игоревич). Contact: support@open-learn.ai or the Contact page on the website.
1. The Service
OpenLearn AI provides a chat interface and Telegram bot that route your prompts to third-party AI models and return their responses. We do not build the underlying models; we orchestrate requests, track usage, and bill accordingly.
2. Eligibility
You must be at least 13 years old (or 16 if you are in the EU) to use the Service. If you are under the age of majority in your jurisdiction, you must have a parent or guardian's consent.
3. Your Account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@open-learn.ai if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service to generate content that is illegal, defamatory, harassing, or that infringes third-party rights.
- Attempt to extract underlying model weights or bypass safety filters.
- Reverse-engineer, scrape at scale, or stress-test the Service without written permission.
- Circumvent rate limits, balance accounting, or billing.
- Resell or white-label the Service without a separate agreement.
- Upload malware or content that violates applicable law.
We may suspend or terminate accounts that violate these rules.
5. Balance and Payments
The Service operates on a pay-as-you-go model. You hold a monetary balance (in RUB or USD); each request deducts its actual cost from that balance, depending on the model you choose and the amount of text processed. There are no subscriptions, plans, or credits — every model and feature is open to all users, limited only by your balance.
Welcome bonus. On sign-up we add a welcome bonus to your balance so you can try the Service. Bonus funds may be spent on requests; they are non-withdrawable and non-refundable.
Top-ups. You can top up your balance from 50 ₽ / $1. Model prices are published on our pricing page and may change with notice.
Access after payment. The Service is delivered electronically: a top-up is credited to your account balance automatically as soon as the payment is confirmed. No separate delivery is required.
Refunds. Top-ups and any unspent balance are non-refundable except where required by law. The welcome bonus is non-refundable.
Taxes. Prices exclude applicable taxes unless stated otherwise; you are responsible for any taxes owed in your jurisdiction.
6. AI-Generated Content
Outputs from AI models are provided on an "as is" basis. They may be inaccurate, incomplete, biased, or offensive. You are responsible for reviewing outputs before relying on them — particularly for legal, medical, financial, or safety-critical decisions.
Subject to the policies of the underlying AI provider, you own the outputs you generate. You grant us a limited licence to store and process your prompts and outputs to operate the Service.
7. Intellectual Property
The Service, including the UI, branding, and documentation, is our property or that of our licensors. We grant you a limited, revocable, non-transferable licence to use the Service for its intended purpose.
8. Third-Party Services
The Service depends on third-party AI, payment, and infrastructure providers. Their availability, policies, and pricing are outside our control. Our liability for third-party outages or changes is limited as set out below.
9. Termination
You may close your account at any time. We may suspend or terminate the Service, in whole or in part, with reasonable notice — or immediately if you materially violate these Terms or if continued operation would be unlawful or unsafe.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold us harmless from any claim or demand arising from your use of the Service or your breach of these Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which OpenLearn AI is established, without regard to conflict-of-laws principles. Mandatory consumer-protection rights in your country of residence remain unaffected.
14. Changes
We may update these Terms from time to time. Material changes will be posted here with a revised "Last updated" date and, where significant, notified by email. Continued use of the Service after the effective date constitutes acceptance.
